Payment Addendum
Section 1: Introduction
This Payment Addendum (“Addendum”) is made and entered into by and between CellularSmarts (“Company”) and its site users (“Users”). The purpose of this Addendum is to establish the terms and conditions governing payments, refunds, and related financial transactions to ensure the protection and satisfaction of both parties.
Section 2: Payment Terms
2.1 Accepted Payment Methods
- Credit/Debit Cards: Visa, MasterCard, American Express
- Electronic Funds Transfer (EFT)
- PayPal
- Other methods as authorized by the Company
2.2 Payment Processing
All payments made by Users must be processed through the Company’s secure payment gateway. No payment information will be stored on the Company’s servers to ensure maximum security.
2.3 Payment Confirmation
Upon successful payment, Users will receive an electronic receipt via email confirming the transaction. This receipt will include the transaction ID, amount paid, and any relevant details about the purchase.
Section 3: Refund Policy
3.1 Eligibility for Refunds
Refunds are available under the following conditions:
- The product or service was not delivered as described.
- The product or service was defective or malfunctioning.
- The User was charged incorrectly due to a processing error.
3.2 Refund Process
To request a refund, Users must contact the Company’s customer service within 30 days of the transaction date. The request must include the transaction ID, reason for the refund, and any supporting documentation. Refunds will be processed within 7-14 business days of approval.
Section 4: User Responsibilities
4.1 Accurate Information
Users are responsible for providing accurate and up-to-date payment information. The Company is not liable for any issues arising from incorrect information provided by the User.
4.2 Compliance with Laws
Users must comply with all applicable laws and regulations regarding financial transactions. Any fraudulent activity will result in immediate account termination and possible legal action.
Section 5: Company Responsibilities
5.1 Data Protection
The Company is committed to protecting Users’ payment information with industry-standard security measures, including encryption and secure socket layer (SSL) technology.
5.2 Transparency
The Company will provide clear and transparent information about all charges, fees, and payment policies on its website. Any changes to the payment terms will be communicated to Users in advance.
Section 6: Dispute Resolution
6.1 Informal Resolution
In the event of a payment dispute, Users are encouraged to contact the Company’s customer service for an informal resolution before pursuing further action.
6.2 Arbitration
If the dispute cannot be resolved informally, both parties agree to submit to binding arbitration in accordance with the rules of the American Arbitration Association. The decision of the arbitrator will be final and binding.
Section 7: Amendments
This Addendum may be amended only by a written agreement signed by both the Company and the User. Any amendments will be posted on the Company’s website and will take effect immediately upon posting.
Section 8: Governing Law
This Addendum will be governed by and construed in accordance with the laws of the state in which the Company is headquartered, without regard to its conflict of law principles.
Section 9: Severability
If any provision of this Addendum is found to be unenforceable or invalid, the remaining provisions will continue to be in full force and effect.
Section 10: Acceptance
By using the Company’s services and making payments, Users acknowledge that they have read, understood, and agree to be bound by the terms of this Payment Addendum.
